Criminal Matters

• European Arrest Warrants

For European Arrest Warrants issued by the authorities of the Republic, for which there is information that the requested persons are located in the United Kingdom, upon receipt of official information on their arrest, along with the EAW, Extradition Request will also be sent under the Council of Europe Convention for Extradition, so that a parallel legal basis is available.

• Requests for transfer of convicts

For Requests for Transfer of convicts sent and pending before the British authorities for recognition and enforcement of the judgment under the Framework Decision 2018/909/JHA, in case of non-completion of the recognition procedure until the exit date, new requests for transfer will be sent having as legal basis the Council of Europe Convention on Transfers.

• Mutual Legal Assistance Requests (MLA)

For Mutual Legal Assistance (MLAs) Requests sent by the Cypriot Authorities, either under the EU Mutual Assistance Convention, or as European Investigation Orders based on the relevant Directive 2014/41/EU, the Ministry of Justice and Public Order, as the Central Authority will request from the competent British Central Authority that all Requests not executed until the exit date, be considered as having been sent under the relevant Council of Europe Mutual Assistance Convention.

 

Civil Matters

• Service of Documents

For requests for service of documents sent based on E.U. Regulation 1393/2017, the Ministry of Justice and Public Order, as the Central Authority, will address the competent British Central Authority and request that all requests not executed by the exit date, be considered as having been sent under the relevant Hague Convention on Service of Documents.

Furthermore, service requests by lawyers during the period before the due date, must be submitted having as legal basis the above mentioned Hague Convention, using the specific forms provided by the Convention.

• Obtaining of Evidence

For requests for obtaining evidence submitted based on E.U. Regulation 1206/2001, the Ministry of Justice and Public Order, as the Central Authority, will contact the competent British Central Authority and request that all requests not executed by the exit date, be considered as having been sent under the applicable Hague Convention on Obtaining Evidence.
